TREE LIFE TERMS AND CONDITIONS

1) General Conditions:
Read the following End-User Software License Agreement related to the use of TREE LIFE. This Agreement and TREE LIFE‘s Privacy Policy shall comprise the entire agreement (“the Agreement”) between Tree Life SRL. (hereinafter “the PROVIDER”) and you regarding the use of TREE LIFE's software.
Legal Notices: by clicking on the “I AGREE” button at the bottom of this window, you agree to have read and agreed to all the terms of this Agreement and your obligations, becoming a party to this Agreement. The PROVIDER is only willing to grant you this software License if you agree to all the terms contained herein. Should you not agree to all the terms of this Agreement, click on the “CANCEL” button and do not download, install, or use TREE LIFE's software.

The following Agreement is a legal contract between you (the end-user, whether an individual or a legal entity) and the PROVIDER.
The PROVIDER grants you a license to this software only to use in accordance with the terms contained herein.

2) License Agreement:
License Grant: The PROVIDER grants you a license to use the version of this software program's executable code through a QR code, USB storage device, or other electronic devices approved by the PROVIDER.

Intellectual and Industrial Property Rights: TREE LIFE is owned by the PROVIDER and is protected by copyright laws, including software intellectual property rights, and industrial property rights laws of the Argentine Republic and the provisions of international treaties. Therefore, you hereby acknowledge that no intellectual property right owned by TREE LIFE is transferred to you but the limited use license, which is non-transferable, non-exclusive, and revocable, granted hereby. This includes the protection of trademarks, trade names, product names, and trademark logos contained in or used by TREE LIFE, which are registered trademarks or industrial property rights which are the property of their respective owners. The use of said trademarks shall be in compliance with the legislation currently in force protecting the rights of trademark owners. The use of such trademarks shall not constitute: 1) any affiliation of the PROVIDER and its grantors with such trademark owners, or 2) any award or approval granted by such company to the PROVIDER and its grantors and its products or services.

Exclusive Property: The PROVIDER or its right holders have and shall have the sole and exclusive property of TREE LIFE source code and object code, all media and documents related to TREE LIFE, including its development or operation, test or use, and all its reports and copies, and all the intellectual property rights associated with it, including, but not limited to, trademarks, copyright, trade secrets or technical knowledge. In addition, you acknowledge that all intellectual property rights, including trademarks, patents, software, promotional materials, videos, audio files, presentations, marketing collateral, leaflets, etc., are and shall remain the exclusive property of their respective owners.
The government of the Argentine Republic protects the presumption that the PROVIDER, in order to develop the software and its documentation, had to incur expenses and make investments, and that no parts of it is in the public domain, therefore, improper or unauthorized use of TREE LIFE implies or may imply a direct infringement of the PROVIDER's property right as a software developer, which may and shall be punishable under the current legislation in force, and therefore, it shall be duly compensated in case of infringement of such rights.

Limitations: Unless it is explicitly permitted hereby, you are not allowed to modify TREE LIFE or create any derivative work from TREE LIFE, or compile, reverse engineer, reverse assemble or try to derive its source code otherwise. Neither are you allowed to delete or alter any trademark, logo, copyright or other proprietary notices in TREE LIFE or use any methods other than QR Code or the installation provided through USB storage device, or other electronic devices approved by the PROVIDER in order to have access to TREE LIFE, or use TREE LIFE to promote unlawful actions.
Any violation of the aforementioned guidelines, without the PROVIDER's written consent, will result in automatic termination of this license, notwithstanding other penalties provided for by the legislation in force, and consequently you will have to stop using the QR Code and delete the copy of TREE LIFE in case you are using a USB storage device. In addition, you acknowledge and expressly agree that any transfer, sub-license, or resale of TREE LIFE is strictly forbidden and will result in pursuing civil, commercial, or criminal actions that may apply, regardless of automatic and immediate termination of the granted license.

Updates: The PROVIDER reserves the right to add functions or features to, remove functions or features from, or provide updates or software solutions to TREE LIFE. The PROVIDER has no obligation to inform you about changes made in TREE LIFE. You may be required to enter into a new agreement with the PROVIDER to use a different version of TREE LIFE. In addition, the PROVIDER may require an update when discontinuing the service or compatibility with any version of TREE LIFE without notice.
Possible invalidity of specific clauses of this Agreement: Should any provisions hereof be prohibited or held to be void in accordance with the legislation currently in force, such prohibition or unenforceability shall not invalidate the remaining provisions of this Agreement, which constitutes the entire agreement between you and the PROVIDER regarding TREE LIFE. Offensive Content: You hereby acknowledge being responsible for the content provided by you in TREE LIFE. Therefore, you agree that the PROVIDER shall not be held responsible for the information, content, audio, messages that are offensive, hateful, lustful, racist, politically incorrect, sexually explicit, libelous or otherwise unwanted.
Multiple Platforms: The PROVIDER shall not be held responsible for your device's poor performance caused by using TREE LIFE.

Warranty Disclaimer and Limitation of Liability: The PROVIDER makes no statement, representation, warranty, guarantee or implication whatsoever about using TREE LIFE without temporary faults, interruptions, delays, or other problems, and makes no warranty as to the operation of TREE LIFE being free from interruptions or errors, or such interruptions o errors being immediately corrected as soon as they are detected. The PROVIDER provides TREE LIFE as is, with no guarantees whatsoever, whether express or implied, and the QR Code associated with the service is to be used by only one person as a user.
Receipt of TREE LIFE does not extend any other guarantees, including, but not limited to, guarantees granted for any other products or services of the PROVIDER.

Validity Period: This Agreement shall be in force for as long as you use the TREE LIFE license, and until such use is terminated, for any reasons. This Agreement shall terminate, and the license granted to you hereby will be immediately revoked, without notice by the PROVIDER, in case of non-compliance by the User of any of the provisions hereof. Once the validity period of this Agreement expires, you must remove TREE LIFE from all the devices where it has been installed.

Current Legislation in Force: These general conditions are governed by the Argentine legislation, and are subject to the jurisdiction of the common courts of the Autonomous City of Buenos Aires, with express waiver of any other court or jurisdiction which might apply.
Severability: Should any provisions hereof be prohibited or held to be void, such prohibition or unenforceability shall not invalidate the remaining provisions hereof.

The entire agreement: This Agreement constitutes the entire agreement between you and the PROVIDER regarding TREE LIFE, and supersedes any and all prior communications, representations, understandings, or agreements, whether oral or written, between you and the PROVIDER regarding TREE LIFE.
Tolerance of non-compliance of the obligations assumed by the User hereby shall not constitute a waiver by the PROVIDER of future actions or rights in case of future non-compliance.

3) Privacy Policy of TREE LIFE:
Read the following Privacy Policy regarding the use of TREE LIFE. You must agree to the Privacy Policy before using TREE LIFE. This Privacy Policy and the Terms and Conditions of TREE LIFE comprise the entire agreement between the PROVIDER and you regarding the use of TREE LIFE.
TREE LIFE publicly displays only the data you provide in the public section.
In order to have access to private data, to load, modify, see, or delete them, the access key is required.
You will decide which information is confidential and which one is public, protecting your data with the personal key created by you.

Does TREE LIFE share information with third parties?
The PROVIDER will not share confidential or sensible information with third parties or to improve the functionality quality of TREE LIFE. Nevertheless, the PROVIDER may disclose information when required by law or regulations, or in order to comply with requirements derived from a court or administrative order, or when required by a government agency, if permitted by law. The PROVIDER may also disclose non-confidential information only for statistical purposes and keeping the users' confidentiality.
The PROVIDER takes industry standard measures to help reduce the loss of data and breaches of security. The PROVIDER shall not be held responsible for the loss of data in your own personal computer or unauthorized transfer of personal information to hackers or crackers. By using TREE LIFE you agree that Tree Life SR, the PROVIDER, does not guarantee that the data, whether encrypted or not, are 100% secure, since in order to offer this service, third party services are used.
Advertising: The PROVIDER reserves the right to post advertising services and banners, among others, in TREE LIFE’s website The User expressly acknowledges this, and waives any claims derived from the PROVIDER's reserving such right.

4) Important:
TREE LIFE does not guaranty your security. TREE LIFE does not guarantee you will be helped in case of emergency, need of urgent care or illness. It is simply a tool for the person helping you in case you are in such situations. Bear in mind that the more data you enter, the better information the paramedic or physician assisting you will have in each occasion. More information means better decision-making. In certain circumstances, when the clock is ticking, it may make a big difference in the result. So you should imagine SOMETHING IS ACTUALLY HAPPENING TO YOU NOW: What information do you think would be necessary and essential in order that, based on your condition or health status, you can be treated well, quickly, and effectively? THAT is the information that YOU CANNOT FAIL TO INCLUDE.
The PROVIDER does not state that this program will work efficiently in case of emergency. TREE LIFE does not replace any current or automated telephone system, hardware or software for emergencies or crisis.
Important: Only you are responsible for the information you enter in TREE LIFE, and you and/or the professionals who have made the relevant diagnosis or who are treating you are responsible for the veracity, accuracy, suitability, contemporary relevance or specificity of the information contained and entered in TREE LIFE. Therefore, the PROVIDER does not guarantee the veracity, accuracy, suitability, contemporary relevance or specificity of the aforementioned information, and shall not be held responsible for any possible inconsistencies between the information you enter in TREE LIFE and your actual medical status in the event of an emergency. Please update the information you enter in TREE LIFE periodically.

The PROVIDER shall not be held responsible for any physical or personal problem, mental harm, injury, medical problem, chronic condition, illness, or any other property damage or personal injury that may occur despite using or trying to use TREE LIFE. The failure of TREE LIFE does not constitute grounds for holding the PROVIDER responsible for any damages.
